Terms and Conditions
1. Acceptance of Terms
By using the services of Peregrine Errand and Home Delivery Services ("Peregrine," "we," "us," or "our"), you ("Client," "Customer," or "you") agree to be bound by these Terms and Conditions. These Terms and Conditions govern your access to and use of our services, including but not limited to errand services, dispatch services, home delivery, surprise package delivery, and general goods distribution. If you do not agree to these Terms and Conditions, you may not use our service.
2. Service Description
Peregrine provides logistics, errand/dispatch services, surprise package, and distribution of general goods within Enugu, Enugu State, Nigeria. The specifics of the services, including but not limited to delivery times, locations, and handling of goods, will be agreed upon between Peregrine and the Client at the time of order placement.
3. Ordering and Delivery
3.1. Order Placement: Clients may place orders through our designated channels (e.g., app, phone, website). Clients are responsible for providing accurate and complete information, including sender and recipient details, delivery address, contact information, and item description.
3.2. Delivery Timeframes: Peregrine will make reasonable efforts to adhere to agreed-upon delivery timeframes. However, delivery times are estimates and may be subject to delays due to factors beyond our control, such as traffic, weather conditions, or unforeseen circumstances.
3.3. Delivery Address: Deliveries will be made to the address specified by the Client. Peregrine is not responsible for deliveries made to incorrect or incomplete addresses provided by the Client.
3.4. Recipient Availability: The Client is responsible for ensuring that the recipient is available to receive the delivery at the specified address and time. If the recipient is unavailable, Peregrine may attempt to reschedule the delivery or return the item to the sender, and additional charges may apply.
3.5. Restricted Items: Peregrine reserves the right to refuse to handle or deliver items that are illegal, hazardous, fragile, perishable, or otherwise unsuitable for transportation. The Client is responsible for ensuring that the items are not prohibited.
4. Pricing and Payment
4.1. Pricing: The cost of services will be communicated to the Client at the time of order placement. Prices may vary depending on factors such as distance, item size and weight, and urgency of delivery.
4.2. Payment: Payment for services is due in accordance with the agreed-upon terms. Peregrine may accept various payment methods, as specified.
4.3. Additional Charges: Additional charges may apply for services such as waiting time, redelivery, or handling of items. The Client will be informed of any additional charges before they are incurred.
5. Client Responsibilities
5.1. Accurate Information: The Client is responsible for providing accurate and complete information for all orders.
5.2. Item Preparation: The Client is responsible for adequately packaging and preparing items for delivery to prevent damage during transit.
5.3. Compliance with Laws: The Client warrants that the items comply with all applicable laws and regulations.
6. Peregrine's Responsibilities
6.1. Service Provision: Peregrine will provide the agreed-upon services with reasonable care and skill.
6.2. Item Handling: Peregrine will handle items with reasonable care. However, Peregrine is not liable for damage to fragile items or items that are improperly packaged.
7. Limitation of Liability
7.1. To the maximum extent permitted by applicable law, Peregrine's liability for any loss or damage arising out of or in connection with the provision of services shall be limited to the cost of the services.
7.2. Peregrine shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of profits, loss of business, or loss of data.
8. Indemnification
The Client agrees to indemnify and hold Peregrine harmless from any claims, losses, damages, liabilities, and expenses arising out of or in connection with the Client's use of our services or any breach of these Terms and Conditions.
9. Force Majeure
Peregrine shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, riots, strikes, or governmental actions.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
11. Dispute Resolution
Any dispute arising out of or in connection with these Terms and Conditions shall be resolved through negotiation in good faith. If negotiation fails, the parties agree to submit to the exclusive jurisdiction of the courts of Enugu State, Nigeria.
12. Changes to Terms and Conditions
Peregrine reserves the right to modify or amend these Terms and Conditions at any time. The most current version of the Terms and Conditions will be posted on our website or app, and it is the Client's responsibility to review them periodically.
13. Severability
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms and Conditions constitute the entire agreement between Peregrine and the Client and supersede all prior agreements and understandings, whether oral or written.
